General terms and conditions of business
§1 General
Anna's Coffee Roasting House reserves the right to change or supplement the existing General Terms and Conditions at any time.
Orders received before this date will be processed according to the previously existing General Terms and Conditions.
§2 Scope
Our General Terms and Conditions apply exclusively to the execution of this contract. Any other terms and conditions are not recognized and will not become part of the contract, even if we do not expressly object to them.
§3 Data protection
Pursuant to Section 28 of the Federal Data Protection Act (BDSG), we would like to point out that the data required for business transactions will be processed and stored using an IT system in accordance with Section 33 of the BDSG. Personal data will, of course, be treated confidentially and will not be shared.

§5 Conclusion of contract
The presentation of our products on the website represents a non-binding invitation to the customer to place an order and thus an offer to conclude a purchase contract. The customer submits an offer to conclude a purchase contract by clicking the "Order with payment" button at the end of the ordering process. We then confirm receipt of the order by email (confirmation of receipt). The contract is concluded when we inform the customer by email of our acceptance of the offer (order confirmation). The customer has the opportunity to correct any input errors at any time during the ordering process. Before submitting the order, all entries are clearly displayed and can still be edited.
§6 Right of withdrawal and instructions
If the customer concludes the contract for a purpose that cannot be attributed to his commercial or independent professional activity, the following provisions shall apply to the customer as a consumer within the meaning of Section 13 of the German Civil Code (BGB):
Right of withdrawal
You can revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter or email) or - if the item is handed over to you before the expiry of the deadline - by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB as well as our obligations pursuant to § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To comply with the cancellation period, it is sufficient to send the cancellation or the item in good time.
Cancellation of seminars and training courses
If you cancel a booked seminar or training course within 14 days of the event date, we will retain 50% of the registration fee as a processing fee. We ask for your understanding for this measure.

Consequences of revocation
In the event of an effective cancellation, both parties must return the services received and, if applicable, surrender any benefits derived (e.g., interest). If you are unable to return or surrender the service received and any benefits derived (e.g., benefits of use) to us, or only partially, or only in a deteriorated condition, you must compensate us for the value. You must only pay compensation for deterioration of the item and any benefits derived if the use or deterioration is due to handling of the item that goes beyond testing its properties and functionality. “Testing the properties and functionality” means testing and trying out the respective goods, as is possible and customary in a retail store. Items that can be sent by parcel must be returned at the buyer’s expense and risk. Obligations to reimburse payments must be fulfilled within 30 days. For you, the period begins when you send your cancellation notice or the item; for us, it begins when we receive them.
§7 Prices, delivery and shipping costs
All prices are in euros and include the applicable statutory VAT. Prices are subject to change and errors excepted. Our paper vouchers (offline) are valid for 2 years and cannot be redeemed for cash or exchanged. Vouchers are transferable and can only be redeemed if they are originals and signed by a member of staff.
DHL Domestic Shipping (Germany): The customer bears the packaging and shipping costs of EUR 4.99.
Repackaging of the goods is at our discretion and is for safe shipping. Special shipping options requested by the customer (e.g., express shipping or other additional services) will be charged to the customer depending on the shipping method.
§8 Payment methods
Payment in advance:
For advance payment (prepayment), the invoice amount must be received in our bank account within 10 calendar days of receipt of the invoice. You will find our bank details in the order confirmation email. Please use the respective order number as the reference! As soon as your transfer has been received in our account, the goods will be dispatched. Please note: Transfers (including online transfers) can take 1-3 business days.
Payment via PayPal:
When paying with PayPal, you will be redirected directly to the PayPal website. Log in with your details and confirm the payment. Your PayPal account will be debited immediately! As soon as we receive your payment, the goods will leave our premises.
§9 Delivery and delivery time
We are entitled to make partial deliveries and partial services at any time, provided this is reasonable for the customer.
All dates and deadlines stated by us are non-binding unless otherwise expressly agreed in writing.
§10 Retention of title
If the customer is a consumer, the goods remain our property until full payment has been made.
If the customer is an entrepreneur, we reserve ownership of the purchased item until all claims arising from the business relationship have been settled.
§11 Warranty
We guarantee that the goods sold are in perfect condition and meet the warranted specifications at the time of transfer of risk. For food products, the best-before date refers to proper storage of the goods (protected from light, heat, and moisture, storage temperature 18°C). If the goods are not stored properly, the warranty for defects is void.
In the event of a defect, the statutory provisions shall apply unless restrictions arise from the following.
If the customer is a consumer, they must notify us of obvious defects within two weeks. This period begins upon delivery of the purchased item. The notification must be made in writing. It is timely if it is sent within the deadline. Failure to comply with the deadline will void the customer's warranty rights. Section 444 of the German Civil Code (BGB) remains unaffected.
If the customer is an entrepreneur, we have the right to choose the type of subsequent performance in the event of a defect.
If the customer is an entrepreneur, the warranty period is one year.
Section 11 of these General Terms and Conditions applies to claims for damages due to a defect.
§12 Liability
We are liable to the extent that we, our legal representatives, or vicarious agents can be accused of intentional or grossly negligent conduct. Liability for slight negligence only exists if a material contractual obligation has been breached. If the customer is an entrepreneur and we are accused of negligent conduct, we are only liable for the damage typically incurred.
Liability for damages resulting from injury to life, body, or health remains unaffected. The same applies to statutory liability regardless of fault, in particular liability under the Product Liability Act.
§13 Place of jurisdiction
The law of the Federal Republic of Germany applies exclusively.
The place of performance and jurisdiction is the registered office of Annas Kaffeerösterei.
§14 Final provisions
The law of the Federal Republic of Germany applies exclusively.
The place of performance and payment is 67433 Neustadt an der Weinstraße.
The place of jurisdiction is the court responsible for our registered office.
